Why South African crypto rules look the way they do

South Africa wrote its crypto rules after two of the largest failures in the world happened here. Mirror Trading International collapsed in December 2020 holding bitcoin for more than 260,000 members, and a court later declared it an unlawful Ponzi scheme. Africrypt followed in April 2021: the portal went down, the founders left for the United Kingdom, and roughly 69,000 bitcoin moved through mixing services. The FSCA investigated and then stated publicly that it had found only crypto asset transactions, which were not regulated under any financial sector law, and that it could not act. In October 2022 a crypto asset was declared a financial product under FAIS, and platforms serving South Africans had to apply for a licence by November 2023. Every protection on this page exists because of that gap.

What SARS sees, and when

SARS treats crypto as an asset rather than a currency, which means every disposal is a taxable event: selling to rand, swapping one coin for another, converting to a stablecoin, and paying for something with it. Mining and staking rewards are income at the rand value on the day they are received, taxable before anything is sold. The practical change of the past two years is visibility rather than law: the Crypto-Asset Reporting Framework has participating jurisdictions exchanging platform data automatically, so offshore activity that was once effectively invisible now arrives at SARS without being asked for.

The constraints that are specific to being here

Three local rules shape what a South African can actually do. Exchange control applies to value moved offshore rather than only to currency, so the single discretionary and foreign investment allowances cover crypto transfers as well as bank transfers. Regulation 28 sets the crypto limit for every retirement fund at zero, which closes the one wrapper that gives a deduction going in.
